Terms of Use

Acceptance

By downloading or using Kidzy Learn ("the app"), you agree to these Terms of Use and to Apple's standard EULA. If you do not agree, please do not use the app. The app is provided by Anshul Jain ("we", "us"). Because the app is for young children, these terms are addressed to the parent, guardian or teacher who installs it and who accepts them on the child's behalf.

What Kidzy Learn is

Kidzy Learn is a learning and play app for children roughly ages 2 to 7. It has nine activities: the alphabet, phonics, numbers, tracing, spelling, colors, shapes, quizzes and puzzles, with three age levels of 2 to 3, 4 to 5, and 6 to 7. The activities work offline, it contains no advertising, and it has no chat, no camera, no other users and no way for a child to reach anyone.

It is play, not assessment

Kidzy Learn is an educational play app. It is not a test, an assessment, a screening tool or a diagnosis. Streaks, badges, scores and the learning journey exist to encourage a child to come back tomorrow. They do not measure ability, they are not compared against any standard or against any other child, and nothing in the app should be read as a statement that a child is ahead or behind. If you have any concern about your child's speech, hearing, vision, learning or development, speak to your pediatrician, your health visitor or your child's teacher.

A grown-up should be nearby

You decide how much screen time is right for your child and how closely to supervise it. Tracing and writing practice work best with an adult alongside, and printing a worksheet needs one. You are responsible for the device the app runs on, including whether it is passcode protected and whether purchasing is allowed on it. Apple's own Screen Time controls can limit how long the app is used and can block in-app purchases entirely.

The grown-up gate

Anything that spends money, and every link that opens a web page, is placed behind a math question that a young child is not expected to answer: buying, restoring a purchase, starting the free trial, opening the unlock screen, opening the support, privacy or terms links at the foot of it, sharing a progress card, and renaming or deleting a child's profile. Three wrong answers pause the gate briefly before it can be tried again.

Some things sit outside the gate on purpose, because they spend nothing and reveal nothing: switching between children, printing a tracing worksheet, the reminder explainer that can appear on the home screen once a streak has started, and the shortcut that opens the iOS Settings app if notifications were declined.

The gate is a sensible barrier, not a security system, and an older or determined child may work out the answer. It does not replace your own device settings. If you want a hard stop, turn off in-app purchases in Apple's Screen Time settings.

What is free

Alphabet and Numbers are free forever, with no trial and no purchase needed. The app is fully usable that way, and it always will be.

Trial, free plays and the one-time purchase

The other seven activities include a 3 day free trial with full access. It never begins on its own: the clock starts only when the math gate is passed on a locked activity. It costs nothing, no payment details are taken to start it, and it does not turn into a purchase when it ends.
When the trial has finished, each of those seven activities still gives one free play every day. It is counted per activity, not shared between them, and it resets with the calendar day on the device. Free plays are counted for the device rather than for each child, so switching between children does not create extra plays.
Kidzy Learn Premium is a single one-time purchase, not a subscription. It unlocks every activity, permanently, for the Apple Account that bought it. Nothing renews, nothing is billed again, there is no auto-renewal to switch off and there is nothing to cancel.
Payment is handled entirely by Apple and charged to your Apple Account. The price is shown in the app before you buy and may vary by region. Purchases must be made by the adult who owns the Apple Account.
On a new device, or after reinstalling the app, use Restore Purchase on the unlock screen while signed in with the Apple Account you bought with. Apple will confirm the purchase and the unlock returns at no further cost.
Refunds are handled by Apple under its own policies, not by us. Requests go to reportaproblem.apple.com.

Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Your content

The first name, avatar and age level you enter, and everything your child earns in the app, belong to you. They stay on your device and we never receive them, so we claim no rights over them and we cannot recover them for you (see the Privacy Policy). You choose what to type in, and a nickname or a first initial is perfectly fine. If you share a progress card, it shows your child's name and avatar, and once it leaves the app it is out of our hands.

Acceptable use

You agree not to use the app to infringe intellectual property rights, to attempt to reverse engineer or interfere with it, or to use it in any unlawful way or any way prohibited by the App Store terms. The artwork, audio, text and activities in Kidzy Learn are ours or licensed to us, and are made available to you for your family's or classroom's personal use, not for redistribution. Printed tracing worksheets may be copied freely for the children in your own home or class.

Disclaimer and limitation of liability

The app is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law, including as to the preservation of data on your device. To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages, or for any decision made about a child's education, learning or development based on your use of the app, and our liability is limited to the amount you paid for Kidzy Learn Premium.

Changes

We may update these terms; the current version is always posted on this page with its effective date. Continued use after an update means you accept the revised terms.
